Know Your Rights as a California Worker

 As a California staffing agency, we are committed to ensuring your rights are protected at every assignment, regardless of location, schedule, or length of employment. We remain your employer of record and are responsible for complying with applicable California labor laws.

Meal & Rest Breaks (CA Labor Code)

California law requires the following for most non-exempt employees:

  • Paid rest breaks:
    You must receive a paid 10-minute rest break for every 4 hours worked (or major fraction thereof).
     
  • Meal breaks:
    You must receive an unpaid 30-minute meal break if you work more than 5 hours in a workday.
    A second 30-minute meal break is required if you work more than 10 hours, unless legally waived.
     

You must be relieved of all duties during your meal break. If you are not provided a required break, you may be entitled to premium pay.

If a client site does not relieve you of duties to take required breaks, notify us immediately.

Paid Sick Leave

 (Healthy Workplaces, Healthy Families Act)

Most employees in California are entitled to paid sick leave, which can be used for:

  • Your own illness or medical care
  • Caring for a family member
  • Preventive care
  • Certain safe-time needs

Key points:

  • Sick leave accrues based on hours worked or is provided upfront
  • Unused sick time may carry over, subject to legal caps
  • You may not be retaliated against for using sick leave

Workers’ Compensation

 

You are covered by workers’ compensation insurance from your first day of work.

Workers’ compensation may cover:

  • Medical treatment
  • Lost wages
  • Temporary or permanent disability benefits

If you are injured on the job:

  1. Seek medical attention immediately if needed 
  2. Report the injury to us as soon as possible
  3. Complete a workers’ compensation claim form

Harassment & Discrimination Protections

  California law prohibits harassment, discrimination, and retaliation based on protected characteristics, including but not limited to:

  • Race, color, ancestry 
  • National origin or immigration status
  • Sex, gender, gender identity or expression
  • Sexual orientation
  • Age (40+)
  • Disability or medical condition
  • Religion
  • Pregnancy or family status

These protections apply at all client worksites.
Harassment does not have to come from a supervisor to be unlawful.

If you experience or witness inappropriate conduct, report it promptly.

Retaliation & Whistleblower Protections

  It is illegal for an employer or client to retaliate against you for:

  • Reporting labor law violations 
  • Requesting breaks or overtime pay
  • Using paid sick leave
  • Reporting harassment or discrimination
  • Filing a workers’ compensation claim
  • Cooperating in an investigation 

Retaliation includes termination, reduced hours, discipline, or unfavorable assignments.
